
Probate is the process of settling the estate of a deceased person, resolving claims to his or her estate and distributing the property to the appropriate heirs. Additionally, we assist in the drafting of simple wills, inter-vivos transfers, medical powers of attorney, physician directives and other documents establishing post-mortem intent.
Guardianship for a minor or incapacitated person is administrated through the Texas Probate court. The guardian is appointed by the court to care for the person and property of the incapacitated person, otherwise known as the ward.
We also draft and notarize powers of attorney. Power of Attorney is a legal instrument that is used to delegate legal authority to another individual. The person who signs (executes) a power of attorney is referred to as the Principal. In granting power of attorney, the Principal gives legal authority to another person, called the Agent or Attorney-in-Fact, to make property, financial and other legal decisions on behalf of the Principal.
